Terms of Service

These Terms of Service ("Terms") govern your access to and use of the EOS platform provided by EOS ("we", "our", "us"). By accessing or using EOS, you agree to be bound by these Terms. If you do not agree, do not use the platform.


1. Acceptance of Terms

By creating an account or otherwise accessing EOS, you represent that you are at least 18 years old, have the legal capacity to enter into these Terms, and agree to be bound by them on behalf of yourself or the organisation you represent. If you are accepting on behalf of an organisation, you represent that you have the authority to do so.


2. Service description

EOS is an AI-augmented analytics platform for engineering teams. The platform ingests metadata from connected developer tools (GitHub, Linear, Slack) and produces metrics, trend analyses, and AI-generated summaries designed to help engineering teams understand and improve their delivery performance.

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.


3. User obligations

You agree to:

  • Maintain a valid GitHub account and any other accounts required to connect your developer tools to EOS.
  • Keep your login credentials secure and notify us promptly at hello@eos.dev if you suspect unauthorised access.
  • Use EOS only for lawful purposes and in compliance with all applicable laws and regulations.
  • Not attempt to reverse-engineer, scrape, or otherwise extract data from the EOS platform beyond what is reasonably required for your own use.
  • Not abuse API rate limits or interfere with the service's availability for other users.
  • Not use EOS to store, transmit, or process any data that is unlawful, infringing, or harmful.

We reserve the right to suspend or terminate accounts that violate these obligations without prior notice.


4. Data and privacy

Your use of EOS is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using EOS, you consent to the data practices described in the Privacy Policy.

You retain ownership of all data you bring into EOS through connected integrations. By connecting those integrations, you grant EOS a limited, non-exclusive licence to access and process that data for the sole purpose of providing the service to you.


5. Intellectual property

All software, design, branding, and documentation comprising the EOS platform are the exclusive property of EOS and its licensors. These Terms do not grant you any right, title, or interest in or to the EOS platform beyond the limited right to use it as described herein.


6. Disclaimer of warranties

EOS is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.


7. Limitation of liability

To the maximum extent permitted by applicable law, EOS and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or business interruption — arising out of or in connection with your use of, or inability to use, the service, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the greater of (a) the amount you paid EOS in the twelve months preceding the claim, or (b) one hundred US dollars (USD 100).


8. Governing law and dispute resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. You agree that any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.


9. Changes to these Terms

We may revise these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Material changes will be communicated via email or an in-product notice. Continued use of EOS after changes take effect constitutes your acceptance of the revised Terms.
